1. Introduction

Welcome to the official website of AEVA Atelier (https://aevaatelier.com). These Terms and Conditions (the "Terms") set forth the legally binding terms applicable to your access and use of this website and any transactions conducted through it.

By using this website, including by placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms, together with our Privacy Policy and Cookie Policy. If you do not accept these Terms, you are respectfully advised not to use this website.

AEVA Atelier reserves the right to update or modify these Terms at any time. Your continued use of the website following any such changes constitutes your acceptance of the revised Terms.

2. Use of Personal Information

All personal data submitted via our website will be processed in accordance with our Privacy Policy. By providing your information, you warrant its accuracy and consent to its use for the purposes of fulfilling your order.


3. Website Usage

By accessing and using this website, you agree to comply with the following conditions:

  • The website is intended solely for lawful access and to facilitate legitimate enquiries and purchases.

  • Any false or fraudulent order may result in cancellation and reporting to relevant authorities.

  • Accurate, current, and complete contact information must be provided, including a valid email address and shipping address, for order processing and communication.

  • Orders may not be processed where required information is incomplete or inaccurate.

  • All orders must be placed by individuals who are at least 18 years old and legally capable of entering into binding contracts.

 

4. Contract Formation

To place an order, the online checkout process must be completed and payment confirmed. Following submission, an Order Confirmation email will be issued as acknowledgment of receipt. A binding agreement shall be deemed established upon issuance of a Shipping Confirmation email, which will include an electronic receipt detailing the transaction. These Terms, together with the confirmation documents, constitute the full agreement between AEVA Atelier and the customer.


5. Technical Meals to Correct Orders

Any errors in the personal data provided during the checkout process may be corrected by contacting customer service at contact@aevaatelier.com. If an error is identified after payment has been completed, prompt contact with our customer service team is required in order to initiate any necessary corrections.


6. Availability of Services

All orders are subject to item availability at the time of purchase. If a product is no longer in stock or supply difficulties arise, AEVA Atelier reserves the right to offer substitute products of equal or higher quality and value. If the proposed substitute is not accepted, any amounts already paid for the unavailable item will be refunded in full.


7. Order Refusal

AEVA Atelier reserves the right to remove any product from the website or amend website content at any time, without prior notice. While all efforts are made to process every order, exceptional circumstances may arise in which it becomes necessary to decline an order after an Order Confirmation has been issued. Such circumstances may include, but are not limited to, inventory discrepancies, operational issues, or suspicion of fraudulent activity.

In cases where the refusal of an order is due to an internal error or issue on the part of AEVA Atelier, a full refund will be issued, along with a complimentary perk as a gesture of goodwill. In all cases, notice will be provided at the earliest opportunity. AEVA Atelier shall not be held liable for the removal of products or the refusal to process an order once an Order Confirmation has been sent.

 

8. Delivery

Delivery services are applicable worldwide. All orders are subject to availability. Unless otherwise stated in the Order Confirmation, AEVA Atelier aims to dispatch all orders within 45 days of confirmation. Delivery timeframes may be extended in the event of exceptional circumstances, including but not limited to:

  • Delays in communication or customs clearance;

  • Unforeseen logistical disruptions.

Should a delay occur, timely communication will be provided, along with the option to proceed with an adjusted delivery timeline. If delivery exceeds 14 business days beyond the estimated total delivery period (inclusive of processing and shipping times), cancellation of the order with a full refund will be offered.

For the purpose of these Terms, delivery is deemed to have occurred when the recipient signs for the goods at the specified delivery address.

AEVA Atelier cooperates with third-party carriers to deliver orders worldwide. If the courier is unable to deliver the goods after two attempts, they will attempt to locate a secure location to leave the parcel. If our delivery partners are still unable to deliver after reasonable attempts, your parcel may be returned to AEVA Atelier's warehouse. In such instances, the parcel may be re-dispatched to the default delivery address, but additional delivery charges may apply.


9. Transfer of Ownership and Risk

Title to the products shall pass to the customer only upon full receipt of all amounts due, including delivery charges. Risk of loss or damage to the products transfers upon delivery, as defined in Clause 8 (“Delivery”), which is deemed complete once the goods have been signed for at the agreed delivery address.


10. Price and Payment

Product prices are clearly stated on the AEVA Atelier website at the time of purchase. AEVA Atelier reserves the right to modify prices at any time without prior notice. However, such changes will not apply to orders for which an Order Confirmation has already been issued.

In the event of a pricing error for a product that has been ordered, the customer will be notified as soon as possible. The customer may then choose to proceed with the order at the corrected price or cancel the order and receive a full refund. If contact cannot be established, the order will be cancelled and all amounts paid will be reimbursed. AEVA Atelier is under no obligation to honor an incorrect price if the error is obvious and could have reasonably been identified as such.

All product prices displayed exclude applicable taxes and delivery charges unless explicitly stated otherwise. Additional fees may apply for delivery and taxes as stated during checkout.

AEVA Atelier is responsible for all charges related to the initial product cost, delivery fees, and applicable domestic taxes as stipulated during checkout. Any customs duties, import taxes, or additional fees imposed by the destination country are the sole responsibility of the recipient. These charges, which vary depending on the regulations of each country, must be borne by the customer and are not included in the final amount collected at the time of purchase.

Products selected for purchase will be added to the customer’s shopping basket. To finalize the order, the full checkout process must be completed, including verification of order details and payment. During the checkout process, all applicable charges—such as delivery fees and taxes—will be clearly disclosed. Customers are advised to carefully review the full breakdown of charges before submitting payment.

Accepted payment methods include Visa, MasterCard, and PayPal. All transactions are encrypted for security. By submitting payment, the customer confirms ownership of the payment method used.

All transactions are subject to verification and authorization by the card issuer. AEVA Atelier shall not be liable for delays or inability to complete an order where payment authorization is not granted.


11. Purchases as a Guest Customer

AEVA Atelier provides the option to make purchases as a guest without the need for account registration. In such cases, only the personal information necessary to process and fulfill the order will be collected. Upon completion of the purchase, the customer may choose to register for an account or continue as a non-registered user.


12. Express Checkout

AEVA Atelier offers an Express Checkout feature to streamline the purchasing process. This service enables returning customers to complete transactions without re-entering shipping, billing, or payment details.

To utilize Express Checkout, customers may opt to securely store card information during the payment process. Stored data includes card number, cardholder name (as it appears on the card), and expiration date. Use of this feature is subject to acceptance of AEVA Atelier’s applicable privacy policies and conditions.

By enabling Express Checkout, the customer authorizes charges to the selected payment method. Card usage is subject to the terms agreed upon with the card issuer.

Multiple cards may be saved under a customer profile; however, the most recently stored card will be designated as the default payment method for Express Checkout transactions. Before completing payment, customers are strongly advised to carefully review all order information, including product details, delivery address, payment method, and applicable fees, to ensure accuracy. If incorrect information is shown during the Express Checkout process, the customer must refrain from completing the purchase and instead proceed through the standard checkout.

This feature is not available for guest purchases.


12. Order Cancellations

To ensure timely processing, all orders are initiated immediately upon receipt of payment. As a result, AEVA Atelier is unable to accommodate order cancellations, amendments, or requests to consolidate shipments once an order has been placed. Customers are therefore advised to verify all order details carefully prior to confirmation and payment.

AEVA Atelier also reserves the right to cancel any order at its sole discretion in the event of:

  • Incomplete or unverifiable payment information;

  • Suspected fraudulent activity.

In such instances, affected customers will be notified promptly, and a full refund will be issued without delay.


13. Return/Refund Policy

We sincerely regret that we are unable to accept returns or offer refunds for change-of-mind purchases at this time.

Because our pieces are made in small, exclusive batches, we are unable to restock returned items without compromising our quality control standards. We understand this may be disappointing, and we truly appreciate your understanding.

However, we will gladly offer a refund or replacement in the rare event that your item is faulty or incorrect, provided the following conditions are met and the issue is reported within 7 days of delivery:

  • Items must be in original condition: unworn, unwashed, and undamaged.

  • All original tags must remain attached.

  • Items must be returned in original packaging, including garment bags or boxes.

  • Unboxing Video Required: To ensure transparency and protect your claim rights, please record a video while unboxing your package in case of any damage or missing items.

Please email contact@aevaatelier.com with your order number, photos of the issue, and your unboxing video. Once verified, we will arrange a complimentary return and issue a full refund or send a replacement, including any applicable shipping costs. Refunds will be issued to the original form of payment upon inspection and approval of the returned item(s). Please allow up to 14 business days for the refund to be processed. 

AEVA Atelier reserves the right to refuse return or replacement claims in cases where insufficient evidence is provided or where the returned product does not meet the required conditions outlined above. This includes, but is not limited to, items that are not in original condition, missing tags, lacking original packaging, or without an accompanying unboxing video. Decisions regarding the eligibility of a return or replacement request will be made at the sole discretion of AEVA Atelier.


14. Exchange Policy

We offer exchanges for the same item in an alternative size, subject to availability.

To initiate an exchange, contact contact@aevaatelier.com within 7 days of delivery. Exchange items must meet the same return conditions outlined above.

Please note that the customer will cover all shipping costs related to exchanges.

In the event that the requested size is unavailable, we regret that we are unable to fulfil the exchange due to the limited production of our collections. As a gesture of appreciation for your understanding, we will gladly offer a complimentary benefit or exclusive offer where possible.


15. Liabilities and Waiving Liability

Unless expressly stated otherwise in these Terms, AEVA Atelier’s liability in relation to any product purchased through this website shall be strictly limited to the purchase price paid for that product.

This limitation shall not apply in the following situations:

  • In the event of personal injury resulting from AEVA Atelier’s negligence;

  • In cases of fraud or fraudulent misrepresentation;

  • In any circumstance where exclusion or limitation of liability would be unlawful.

To the fullest extent permitted by law, AEVA Atelier shall not be liable for indirect or consequential losses of any kind, regardless of cause, including but not limited to:

  • Loss of income or revenue;

  • Loss of business or profits;

  • Loss of anticipated savings;

  • Loss of data;

  • Loss of business opportunity or management time.

Due to the inherent limitations of digital communications, AEVA Atelier does not guarantee the accuracy, completeness, or security of data transmitted through the website, except where explicitly stated.

All product information, descriptions, and materials provided on this website are offered on an “as-is” basis, without express or implied warranties, unless legally required. Products are deemed to conform with the contract if they: (i) match the description provided; (ii) are suitable for their intended use; (iii) exhibit the expected quality and performance of comparable items.

To the extent permitted by law, all other warranties are excluded unless they cannot be lawfully disclaimed.


16. Resell

AEVA Atelier does not authorize or encourage the resale of its products in any form without prior written approval. Any individual or entity engaging in resale activities without such consent assumes full responsibility for any resulting claims, disputes, or liabilities arising from their customers. 

AEVA Atelier bears no responsibility for issues related to products purchased through unauthorized resellers. Only items distributed directly by AEVA Atelier or its officially designated stockists are eligible for support under the brand’s policies.


17. Intellectual Property

All content, design elements, and materials featured on this website—including, but not limited to, text, graphics, logos, images, videos, and product designs—are the exclusive intellectual property of AEVA Atelier or are used with the permission of their rightful owners.

These assets are protected by copyright, trademark, and other applicable intellectual property laws. No portion of the website may be copied, reproduced, distributed, modified, or used in any manner without the prior written consent of AEVA Atelier.

This provision does not restrict the limited use of the website necessary for accessing personal order information or contact details for legitimate customer service purposes.


18. Website Security and Misuse

Users must not misuse this website by knowingly introducing viruses, malware, trojans, worms, logic bombs, or any other material that is malicious or technologically harmful. Attempts to gain unauthorized access to the website, its server, or any connected databases or systems are strictly prohibited.

Any act intended to disrupt or interfere with the proper functioning of this website—including denial-of-service attacks or distributed denial-of-service attacks—is a serious breach of these Terms. Such actions will be reported to the appropriate authorities, and AEVA Atelier will fully cooperate to disclose the identity of the responsible parties.

In the event of such a breach, AEVA Atelier reserves the right to immediately revoke access to the website. AEVA Atelier shall not be held liable for any damage or loss caused by such attacks or by viruses or other technologically harmful material that may infect users’ equipment, programs, data, or other proprietary material as a result of using this website or downloading content from it.


19. External Links

This website may contain links to external websites or third-party content provided for informational purposes only. AEVA Atelier does not operate or control these external sites and assumes no responsibility for their content, policies, or practices. Accordingly, AEVA Atelier shall not be liable for any damages, losses, or issues that may arise from accessing or using such third-party resources.


20. Communications

Certain notices and information that AEVA Atelier is required to provide by law must be delivered in written form. By using this website, you consent to receive such communications electronically.

AEVA Atelier may contact you via email or provide notices by posting them on this website. For contractual purposes, you agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

This provision does not affect any statutory rights that may apply.


21. Notices and Service of Communication

All communications intended for AEVA Atelier must be submitted through our email to contact@aevaatelier.com. Unless otherwise stated in these Terms, communications from AEVA Atelier will be delivered via email.

It is understood that notices will be deemed received:

  • At the time of posting, if published on our website;

  • Twenty-four (24) hours after an email is sent;

Sufficient proof of notification shall be deemed to include confirmation that an email was successfully sent to the recipient’s designated email address.


22. Force Majeure

Neither party shall be held liable for any failure or delay in fulfilling its obligations under these Terms where such failure or delay is caused by circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, governmental orders, pandemics, or disruptions to transportation or communication systems.

The obligations of both AEVA Atelier and the customer under these Terms will be suspended for the duration of any force majeure event. AEVA Atelier will make all reasonable efforts to notify customers of such an event and to resume performance as soon as reasonably possible.


23. Waiver Of Rights

Any failure by AEVA Atelier to enforce, at any time, any of the provisions of these Terms or to require strict performance by the customer of any provision shall not be construed as a waiver of any provision or right. No waiver by AEVA Atelier of any breach or default shall constitute a waiver of any preceding or subsequent breach or default.

No waiver of any part of these Terms shall be effective unless expressly stated as such in writing and communicated in accordance with Clause 21 (“Notices and Service of Communication”).


24. Severability

If any provision of these Terms, or any part of a provision, is found to be unlawful, void, or unenforceable by a competent authority, such provision or part shall be deemed severed from the remainder of the Terms. The validity and enforceability of the remaining provisions shall remain unaffected and shall continue in full force and effect.

 

25. Entire Agreement

These Terms, together with any referenced documents, constitute the entire agreement between AEVA Atelier and the customer in relation to the subject matter herein and supersede any prior agreements, understandings, or communications—whether oral or written.

Both parties acknowledge that they have entered into this agreement without relying on any statement, representation, or promise not expressly included in these Terms. No party shall have any remedy in respect of any statement made prior to this agreement unless such statement was made fraudulently. The sole recourse in the event of a breach shall be for breach of contract, as governed by the terms outlined herein.


26. Modifications to Terms 

AEVA Atelier reserves the right to review, revise, and update these Terms at any time without prior notice. Any modifications will be published on this website and will take immediate effect upon posting, unless otherwise required by law.

Customers will be subject to the Terms in effect at the time of placing an order or using the website, except where retroactive changes are mandated by law or governmental authority. In such cases, the updated Terms may also apply to orders previously placed.


27. Governing Law and Jurisdiction 

These Terms and any transactions conducted through this website shall be governed by and interpreted in accordance with the laws of the Socialist Republic of Vietnam.

Any disputes or claims arising out of or in connection with the use of this website or any purchases made through it shall be subject to the exclusive jurisdiction of the courts of Ho Chi Minh City.

Nothing in this clause shall affect any statutory rights available to consumers under applicable consumer protection laws.
